行政規則之意義： 所謂行政規則者，係指在行政組織內，由上級機關對下級機關，或由長官對屬員，所為有關行政組織或行政行為之普遍抽象規定(行政程序法第159條第1項參照)。 行政規則雖由行政部門制定，但所規範者為行政內部之事項，無需法律之授權，此為其與「法規命令」之不同處；行政規則係行政內部之普遍抽象規定，不同於在行政內部由上級機關或長官對下級機關或屬員所為，應如何作成特定行為之具體指示，此即為其與「指令」不同之處所在。
